Denial of Bar Admission

Admission to the USPTO Bar or State Bar may be delayed or denied if questions are raised regarding the applicant’s character. Often character issues arise from prior criminal arrests or convictions as well as civil court judgments. Bar Counsel, including the OED Director, have a great deal of discretion in determining whether an individual satisfies the character requirements of the admission process. That discretion, however, is not unfettered, and individuals who are denied admission to the USPTO Patent Bar have rights within the agency and the courts.
